Roots Health Clinic – Terms & Conditions and Informed Consent

These Terms and Conditions (“Terms”) govern the use of all services and products offered under the name Roots Health Clinic (“Roots”, “we”, “us”, “our”), including in‑person sessions and any online products such as courses, programmes, and digital content (together, the “Services”).

By booking an appointment, purchasing any online product, or otherwise using our Services, you confirm that you have read, understood, and agree to these Terms.
If you do not agree with these Terms, you should not use our Services.

1. Who We Are & Legal Structure

“Roots Health Clinic” is an umbrella name used to describe and promote services provided by:

  • Independent sole practitioners, and

  • Roots Consulting s.r.o., and

  • Roots Products s.r.o.

Roots Health Clinic itself is not a separate legal entity.

Depending on the specific service or product you purchase, your contractual relationship is with either:

  • an individual sole practitioner, or

  • Roots Consulting s.r.o., or

  • Roots Products s.r.o.

The relevant contracting party will be stated on your invoice, booking confirmation, or product receipt. Each practitioner and company is responsible only for the services and products they personally provide or sell.

Our Services are described in more detail on our website (for example, chiropractic, physiotherapy, massage, functional movement, and hypnotherapy, and the conditions we can support).

2. Nature of Our Services – Important Health Disclaimer

We offer the following non-medical wellness services:

  • Chiropractic

  • Physiotherapy

  • Massage

  • Functional Movement

  • Hypnotherapy
     

2.1 Non-medical facility

  • Roots operates as a non-medical, wellness-focused clinic.

  • We are not a medical facility, and our clinicians are not acting as medical doctors.

  • We do not provide:

    • medical diagnosis,

    • medical treatment of disease, or

    • prescriptions or medication management.
       

2.2 No diagnosis, no treatment or cure of disease

You understand and agree that:

  • We cannot diagnose any medical condition or disease.

  • We do not treat, heal, or cure any disease, illness, or medical condition.

  • Our Services are not intended to replace the care of your general practitioner, specialist, or any other medical professional.

Any reference to symptoms or “what Roots can help with” is to explain how we support overall function and well‑being, not to claim that we medically treat or cure any specific condition.
 

2.3 Rekonvalescence / rekondice / regenerace

Our Services are intended to support:

  • Rekonvalescence – convalescence; gentle support for your body during recovery after periods of illness, injury, or stress.

  • Rekondice / regenerace – reconditioning and regeneration; improving function, mobility, posture, strength, and overall well‑being.

In English: We provide supportive care for recovery, reconditioning, and regeneration, helping your body move, function, and feel better after strain, illness, injury, or stress. This is wellness and functional support, not medical treatment of disease.
 

2.4 No guarantee of healing or cure

  • Chiropractic, physiotherapy, massage, functional movement, hypnotherapy and other manual or mind–body techniques offered at Roots do not heal or cure any disease.

  • These approaches support your body’s own natural regulatory and recovery processes, but no specific outcome or cure is guaranteed.
     

2.5 Not a substitute for medical care

Our Services are complementary to, not a substitute for, conventional medical care.

You should consult your medical doctor or appropriate healthcare professional for:

  • any new, severe, or rapidly changing symptoms,

  • persistent or unexplained pain,

  • suspected infections, fractures, neurological symptoms, or

  • any medical emergency.

In case of emergency, always contact emergency services first.

3. Client Responsibilities

By using our Services, you agree that:

  1. You remain responsible for your own health.
    You will maintain appropriate medical care and check‑ups with your doctor or specialist as needed.

  2. You provide accurate information.
    You will give full and accurate information about:

    • current symptoms and complaints,

    • past injuries, surgeries, and medical conditions,

    • medications, supplements, and allergies,

    • pregnancy or suspected pregnancy, and

    • any relevant lifestyle factors.

  3. You keep us informed of changes.
    You will promptly tell your practitioner about:

    • any change in your health status,

    • worsening of symptoms or new symptoms, or

    • any side effects you believe may be related to care at Roots.

  4. You understand the limits of our role.
    You understand that our role is to support functional recovery, movement, comfort, and well‑being, not to diagnose or medically treat disease.

4. Online Products and Courses

Roots may offer online products, including but not limited to:

  • online courses, programmes or workshops,

  • pre‑recorded video or audio content,

  • downloadable PDFs, workbooks, or guides,

  • live online classes, calls or webinars.
     

4.1 Nature of online content

  • All online content is provided for general information, education, and wellness support only.

  • It does not constitute medical, psychological, or psychiatric advice, nor an individualized treatment plan.

  • Accessing online content does not create a doctor–patient or psychotherapist–client relationship.
     

4.2 No guarantee of results

  • We do not promise or guarantee any specific results, healing, or cure from any online product.

  • Your results depend on your individual circumstances, health status, and level of engagement.
     

4.3 Intellectual property

Unless stated otherwise in writing:

  • All online content remains the intellectual property of Roots Consulting s.r.o., Roots Products s.r.o., the individual practitioner, or their licensors.

  • When you purchase access to an online product, you receive a personal, non‑transferable, non‑exclusive licence to use the content for your own personal use only.

You may not:

  • share, resell, or redistribute the content,

  • upload it to public or shared platforms,

  • claim the content as your own work, or

  • use it for commercial teaching, training, or resale without our written permission.
     

4.4 Access period & technical requirements

  • Any access period (e.g. lifetime access, fixed‑term access) will be stated on the product page or at checkout.

  • You are responsible for having the internet connection, device, and software required to view or download the content.
     

4.5 Refunds for online products

Refunds for online products are provided only:

  • as described in the refund policy applicable to that specific product at the time of purchase, and

  • in accordance with any mandatory consumer rights under applicable law.

Because digital content is typically available immediately, you may lose any statutory right of withdrawal once you begin downloading or streaming the content, depending on local law.

5. Appointments, Bookings & Online Booking System

5.1 Booking an appointment

Appointments may be booked online, by phone, or in person (where available).

By booking an appointment, you confirm that:

  • You are at least 18 years old and have the legal capacity to consent, or

  • You are the parent/legal guardian booking and consenting on behalf of a minor.

By booking an appointment for our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
 

5.2 Online Booking System & Client Portal (JaneApp)

We use an online booking system, accessible at https://rootshealth.janeapp.com, to manage appointments and client information (the “Online Booking System” or “Client Portal”).

When you create a profile or book through the Online Booking System:

  • Your client profile and contact details are stored there, including basic information needed for scheduling, reminders, and communication.

  • Your profile may include intake information and health history that you choose to share with us.

  • You may upload relevant files or documents (such as reports, referral letters, or forms) directly through the Client Portal, where enabled.

  • If you prefer, you can also send documents to us by email at info@rootshealthclinic.cz.

Through rootshealth.janeapp.com, you can:

  • Book appointments with practitioners working under the Roots Health Clinic umbrella,

  • Change or reschedule existing appointments (subject to availability and our cancellation policy), and

  • Cancel appointments, in accordance with the notice periods and fees described in these Terms (including any late‑cancellation or no‑show fees).

You are responsible for:

  • Keeping your login details confidential, and

  • Ensuring that the information in your client profile is accurate and up to date.

If you suspect unauthorised access to your account, please notify us as soon as reasonably possible at info@rootshealthclinic.cz or +420 733 304 524.

By using the Online Booking System, you consent to your information being processed for the purposes of managing your bookings, communication, and care within the scope of services offered under Roots Health Clinic.
 

5.3 Cancellations & missed appointments

(Adjust the notice period/fee to your exact clinic policy if needed.)

  • If you need to cancel or reschedule, please do so at least 24 hours before your appointment time.

  • Cancellations made with less than 24 hours’ notice, or missed appointments (“no‑shows”), may be charged up to 100% of the session fee.

  • We reserve the right to waive or enforce this fee at our sole discretion.

  • You may cancel or reschedule via the Online Booking System where available, or by contacting us directly.
     

5.4 Late arrivals

  • If you arrive late, your session may need to be shortened to respect other clients’ appointments.

  • The full fee may still be charged for the originally booked appointment time.

6. Fees, Payments & Currency

  • Service fees and product prices are displayed on our website, booking platform, or communicated at the time of booking or purchase.

  • We reserve the right to change prices at any time; this does not affect confirmed and already paid bookings.

  • Payment may be required in advance for online bookings or for online products, or at the time of service for in‑person visits.

  • We accept the payment methods specified by the clinic at the time of booking (e.g. cash, card, bank transfer).

  • Prices are typically stated in CZK (Czech Koruna), unless otherwise indicated.

7. Risks, Limitations & Informed Consent to Care

  • This section is written in the first person (“I”) so it can function as a separate informed consent form if needed.

  • By proceeding with care at Roots Health Clinic, I acknowledge and agree to the following:

  • Understanding the information
    I have read and understood all the above contained in this form and any accompanying explanations about the nature of the Services at Roots.

  • Consent to assessment and therapy
    I declare that I am giving consent for:

  • the initial history taking,

  • physical examination, and

  • therapy/treatment
    if the practitioner justifies it to be appropriate, within the scope of chiropractic, physiotherapy, massage, functional movement, or hypnotherapy as offered at Roots.

  • Risks of manual and physical therapy
    I acknowledge that I understand the rare risks associated with manual therapy. These uncommon risks associated with my proposed care include (although are not limited to):
    muscle and joint soreness or strains, tiredness, nausea and dizziness, fractures, disc injuries, strokes (or stroke‑like episodes), and an exacerbation and/or aggravation of my underlying condition.

  • Duty to ask questions
    I understand that it is my duty to ask questions about the nature, extent, and purpose of the proposed management and to allow myself sufficient time to make a decision about giving consent for care to proceed.

  • Attendance, care and results
    I acknowledge that I am aware of and understand that potential risks and results are dependent on my attendance, my level of participation, and the care provided. I understand that no specific result or cure can be guaranteed.

  • Limits of what a practitioner can foresee
    I do not expect the practitioner to be able to anticipate all potential risks and complications associated with the proposed care.

  • No healing or cure of disease
    I understand that chiropractic, physiotherapy, massage, functional movement, hypnotherapy and other manual therapies do not heal or cure any disease. I understand that:

  • These therapies are intended to support my body’s function, comfort, and recovery,

  • They are not offered as a cure for any medical condition or disease, and

  • Roots Health Clinic is not a medical facility and does not diagnose or medically treat disease.

  • Rekonvalescence / rekondice / regenerace
    I understand that the services provided are intended to support rekonvalescence (convalescence), rekondice and regenerace (reconditioning and regeneration). This means supportive care for recovery, improved function, and well‑being, rather than medical treatment or cure of disease.

  • Right to withdraw consent
    I understand that I can withdraw my consent at any time, and that I may:

  • stop or pause a session, or

  • refuse any technique or recommendation
    at any time, without needing to give a reason. I will communicate my concerns to the practitioner.

  • Scope of consent
    I hereby give my consent to the performance of the proposed treatment by the clinician and/or any other clinician working in this clinic, provided they are acting within their professional scope and have explained the proposed treatment to me.

  • Disclosure of health information
    I confirm that I have informed the practitioner about any:

  • serious medical diagnoses,

  • current medications and treatments,

  • previous surgeries, major injuries, or conditions, and

  • pregnancy, suspected pregnancy, or breastfeeding (if applicable).

  • I understand that it is my responsibility to keep the practitioner updated about changes in my health.

  • Freedom to seek medical advice
    I understand that I am free to seek medical advice at any time and have been advised to consult my medical doctor or specialist for diagnosis, testing, or medical management of any disease, and for any symptom that worries me.

  • By signing (or by proceeding with my appointment), I confirm that I have read, understood, and voluntarily agree to the above.

8. Limitation of Liability

  • To the fullest extent permitted by applicable law, Roots Consulting s.r.o., Roots Products s.r.o., individual practitioners, and any employees or contractors shall not be liable for:

  • any indirect, incidental, special, or consequential damages,

  • loss of income, business, or opportunities, or

  • any outcomes arising from your decisions based on information or care received through our Services.

  • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury directly caused by our gross negligence or wilful misconduct.

9. Minors (Under 18)

  • Clients under the age of 18 must have written consent from a parent or legal guardian.

  • A parent or guardian may be required to attend the session, depending on the client’s age, the type of service, and local regulations.

10. Changes to These Terms

  • We may update or modify these Terms from time to time.

  • The most current version will be made available on our website or booking platform.

  • Continued use of our Services after changes take effect constitutes your acceptance of the updated Terms.

11. Governing Law

  • These Terms are governed by the laws of the Czech Republic, unless mandatory consumer protection laws of your country of residence provide otherwise.

  • Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts of the Czech Republic, unless otherwise required by applicable consumer protection law.
